Terms and Conditions for Tree Surgeon Redbridge
These Terms and Conditions set out the basis on which tree surgery, arboricultural, and related outdoor maintenance services are provided by a tree surgeon in Redbridge and surrounding areas. By making a booking, accepting a quotation, or allowing work to begin, the customer agrees to be bound by these terms. They are intended to create a clear understanding between the service provider and the customer regarding the scope of work, payment, access, safety, cancellations, waste handling, and legal responsibilities. These terms apply to domestic and commercial clients unless otherwise agreed in writing.
For the avoidance of doubt, all references to “we”, “us”, and “our” mean the tree surgery service provider, and “you” or “the customer” means the person, business, landlord, or property owner requesting the service. The words tree surgeon Redbridge, arborist services, and tree surgery services may be used interchangeably in this document and refer to the same type of professional work. If any part of these terms is found to be unenforceable, the remaining provisions will continue to apply.
These terms are designed for general service use and do not replace any legal rights that cannot be excluded under UK law. Nothing in this document limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or any other matter that cannot legally be limited.
1. Booking Process
Bookings for tree surgeon services in Redbridge are normally made after an initial enquiry, site assessment, or review of photographs and supporting information provided by the customer. A quotation may be based on visible conditions only, and any hidden defects, access issues, or safety concerns discovered on arrival may require the quotation to be revised. A booking is not confirmed until the customer has accepted the quotation and any required deposit, written confirmation, or scheduled date has been agreed by both parties.
The customer must provide accurate information at the time of booking. This includes, where relevant, the location of the trees, the number and approximate size of the trees, access arrangements, parking restrictions, overhead hazards, utility lines, tree preservation status, conservation area restrictions, and any known boundary disputes or third-party concerns. If incorrect or incomplete information is supplied, we may need to amend the scope of work, reschedule the visit, or adjust the price.
We reserve the right to decline or postpone work where conditions are unsafe, access is inadequate, weather conditions are unsuitable, or where the work requested cannot reasonably be completed in line with applicable law, industry practice, or safety standards. The customer is responsible for ensuring that lawful permission has been obtained before work begins, including any consents required from landlords, managing agents, freeholders, neighbours, local authorities, or planning bodies. Acceptance of a booking confirms that the customer has the authority to instruct the work.
2. Scope of Work
The precise scope of services will be set out in the quotation, work order, or written acceptance. Services may include crown reduction, crown thinning, pruning, formative tree work, sectional dismantling, stump-related work, deadwood removal, emergency tree work, hedge cutting, and removal of arisings where agreed. Any services not expressly included should be treated as excluded unless confirmed in writing.
If, during the course of the work, additional issues are identified, such as decay, disease, structural weakness, pest activity, or hidden obstructions, we may advise on alternative action. Any extra work must be agreed before it is carried out. Where urgent action is needed to reduce immediate risk, we will act reasonably and in accordance with safety obligations, but any further work beyond the agreed scope will require separate approval.
All tree surgery is inherently variable because each tree, site, and weather condition is different. As a result, any description of the intended outcome should be understood as a professional estimate of the likely result rather than a guarantee of a uniform appearance. Natural variation in tree shape, regrowth, and post-work response is normal. We are not responsible for outcomes that arise from the biological characteristics of trees, seasonal growth, or pre-existing structural defects.
3. Payments and Charges
Prices may be provided as fixed quotations or estimates depending on the available information. A fixed quotation remains valid for the period stated in the offer, provided that the information supplied by the customer remains accurate and the site conditions do not materially change. Estimates are given in good faith but may be adjusted if the final work differs from the original expectation. Unless otherwise stated, all prices are exclusive of VAT where VAT is applicable.
Payment terms will be confirmed before work starts. We may require a deposit for larger or scheduled jobs, and the balance is normally due on completion unless an alternative arrangement has been agreed in writing. Accepted payment methods may include bank transfer, card payment, cash, or another agreed method. The customer must ensure funds are available and that payment is made in full by the due date. Failure to pay on time may result in additional charges, interest, recovery costs, or suspension of further services, to the extent permitted by law.
If the customer delays payment or disputes an invoice without reasonable grounds, we may charge reasonable administration fees for follow-up correspondence and debt recovery. Where work is carried out for a business customer, statutory interest and compensation may apply under the Late Payment of Commercial Debts (Interest) Act 1998, where applicable. Any set-off or withholding of payment is only permitted if agreed in advance or required by law.
Any discounts, promotions, or special rates are offered at our discretion and may be withdrawn at any time before booking confirmation. Material changes requested by the customer after acceptance may lead to revised pricing. In the event of cancellation after materials have been ordered, staff have been allocated, or machinery has been committed to the job, the customer may be liable for reasonable costs already incurred.
4. Cancellations, Delays, and Rescheduling
The customer may cancel or reschedule a booking by giving reasonable notice. Where cancellation is made within a short period before the scheduled visit, we may charge a cancellation fee to cover lost time, labour planning, and administrative costs. The exact amount will depend on the circumstances of the booking and any expenses already incurred. If a deposit has been paid, it may be retained in whole or in part to offset these costs.
We may also need to postpone work due to weather, vehicle breakdown, staff illness, unsafe conditions, access problems, or other circumstances beyond our control. In such cases, we will aim to rearrange the service at a mutually convenient time. We are not liable for losses arising from a reasonable postponement caused by circumstances outside our control, provided we act fairly and communicate the issue promptly.
Tree surgeon Redbridge services often involve work at height, machinery use, and movement of heavy timber. For that reason, safety may require delaying work if high winds, lightning, frozen ground, or excessive rain create increased risk. If a customer requests continuation against professional advice, we may decline to proceed. Any decision made by us on safety grounds will be final for the protection of people, property, and equipment.
5. Customer Responsibilities
The customer must ensure the site is reasonably accessible on the agreed date and time. This includes providing access through gates, driveways, shared entrances, or any other route necessary to carry out the work. The customer should also ensure that vehicles, garden furniture, ornaments, fragile items, hanging lights, and other obstructions are removed or protected before work starts. We are not responsible for delays or additional charges resulting from restricted access or unprepared sites.
The customer must notify us of any known hazards, including underground services, weak structures, hidden drainage, livestock, aggressive animals, asbestos, unstable ground, or the presence of protected species or nesting birds. If any third party may be affected by the work, the customer should take appropriate steps to inform them in advance. Where parking permits or traffic arrangements are needed, it is the customer’s responsibility to obtain them unless we have agreed otherwise in writing.
The customer also confirms that the work requested does not breach lease terms, planning restrictions, insurance conditions, or neighbourhood agreements. We may ask for written evidence of permission before starting work. If a dispute arises between neighbours, landlords, or management companies, the customer remains responsible for instructing the work and for any consequences of that instruction.
6. Liability and Risk
We will exercise reasonable skill and care in carrying out all services. However, tree surgery can involve inherent risks, including falling debris, hidden defects, unpredictable branch movement, and changes in tree stability. The customer acknowledges that work on living trees, stumps, and surrounding ground may cause unavoidable disturbance, including minor bark damage, soil movement, lawn marking, or regrowth patterns. Such matters do not amount to breach of contract if the work has been carried out with reasonable care.
We are not responsible for pre-existing defects, latent decay, structural weakness, or deterioration that becomes apparent after work. Where a tree or branch is identified as hazardous, we may recommend specialist action or a change in approach. Any advice provided is based on observations made at the time and should not be treated as a guarantee of long-term tree health or structural integrity.
Our liability for loss or damage will be limited to the extent permitted by law. We will not be liable for indirect or consequential losses such as loss of profit, loss of business, or loss of enjoyment, except where such limitation is unlawful. If property damage occurs because of our negligence, we will assess the matter fairly and may repair, replace, or compensate at our discretion, subject to insurance cover and legal obligations.
The customer should keep valuables, vehicles, and vulnerable items away from the work area. Where vehicles or structures must remain in place, the customer should inform us in advance so that appropriate precautions can be considered. We cannot accept liability for damage caused by a customer’s failure to follow reasonable instructions, hidden defects in property, or conditions outside our control.
7. Waste, Green Waste, and Environmental Compliance
All tree surgery produces wood, branches, leaves, sawdust, stumps, and other arisings. Unless agreed otherwise, we will remove waste generated by the agreed work and dispose of it in a lawful and environmentally responsible manner. Waste may be chipped, reused, recycled, composted, or transported to a licensed waste facility depending on the nature of the material and the disposal route available.
We operate in accordance with UK waste management requirements, including the duty to transfer waste only to authorised persons or facilities and to handle controlled waste appropriately. The customer must not instruct us to fly-tip, burn waste unlawfully, or dispose of arisings in a manner that breaches environmental law. If the customer asks to keep woodchips, timber, or logs, this must be agreed in advance and may affect pricing, access, and loading arrangements.
Where waste is retained on site at the customer’s request, responsibility for that material passes to the customer once it has been left in the agreed location, subject to any statutory obligations that cannot be excluded. We are not responsible for later movement, reuse, or disposal of materials after handover. If protected wildlife, nesting activity, or environmental constraints are discovered, work may need to be adapted or paused to remain compliant with applicable legislation.
8. Insurance, Ownership, and Equipment
We maintain appropriate insurance cover in relation to the services we provide, subject to policy limits and terms. Evidence of insurance may be made available on request where reasonably necessary. Customers are responsible for ensuring that the trees or property to which the work relates are lawfully owned or controlled by them, or that they have authority from the true owner to instruct the work.
Any equipment, machinery, or materials brought to site remain our property unless otherwise agreed. The customer must not interfere with our tools, equipment, or safety systems. Where our equipment is damaged due to the customer’s actions, unsafe site conditions, or hidden hazards that were not disclosed, the customer may be liable for repair or replacement costs to the extent permitted by law.
All reasonable steps will be taken to protect lawns, paving, driveways, and adjoining surfaces, but some impact from heavy tree surgery vehicles or timber handling may be unavoidable. Where ground conditions are soft or delicate, the customer should inform us before the visit so that suitable precautions can be considered. A request for highly sensitive access may affect pricing and may not always be practicable.
9. Variations, Complaints, and General Provisions
If the customer wishes to change the agreed work, this must be requested as early as possible and may require a revised quotation. Any variation is only binding once agreed by both parties. If a concern arises about the quality of the service, the customer should notify us within a reasonable time and provide relevant details so the issue can be assessed. We will review the matter fairly and may offer a remedy if appropriate.
These terms may be updated from time to time. The version in force at the time of booking will apply to that specific engagement unless a later written variation is agreed. If any external event prevents us from performing the service, we will not be in breach where performance is delayed or impossible due to matters beyond our reasonable control.
Tree surgeon Redbridge services are provided with professionalism, but the customer remains responsible for reviewing the quotation, checking permissions, and ensuring the site is suitable for the agreed work. No person other than the parties to the booking may enforce these terms under the Contracts (Rights of Third Parties) Act 1999 unless explicitly stated otherwise.
10. Governing Law
These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising under or in relation to these terms, except where the law requires otherwise.
By proceeding with a booking, the customer confirms that they have read, understood, and accepted these terms. If any part of this document is unclear, the customer should request clarification before the work is scheduled. Once a booking is accepted, these terms form the basis of the service agreement between the customer and the provider.
